Our Terms&Conditions

Definitions in relation to these terms and conditions include;

“ASP”                         Advanced Safety Plus Ltd

“Learner”                    The person receiving the training supplied by ASP

Representative”      Any person, company or entity that has the authority to enter into an agreement with ASP on behalf of the Learner.

Awarding Body”      The organisation or entity with whom ASP receives accreditation / approval to run a course on which the Learner enrols.

General

  1. Payment terms are 14 days from date of invoice and 14 days before the course commencement date, whichever is the sooner. Payment MUST be received before the course begins. Advanced Safety Plus Ltd reserves the right to refuse admittance to the course until payment in full is received.
  2. Advanced Safety Plus Ltd reserves the right to cancel or defer the dates of courses. In the event of ASP cancelling a course, learners will be deferred to another (ASP scheduled and advertised) course or given a full refund if ASP are unable to provide a course on dates suitable to the Learner.
  3. In the event of cancellation of a course by the Learner or their Representative, the following charges will apply:

  1. ASP reserves the right to charge a cancellation fee of £40 if the Learner or Representative cancels (refund terms as above) Cancellations can be advised to ASP by telephone but must be confirmed in writing, either by post or email. Refund values are calculated from the date written confirmation of the cancellation is received by ASP.
  2. Learner deferral requests must be received no later than 5 working days before the course commencement date, otherwise ASP reserves the right to charge an administration fee of £40. ASP will make all reasonable attempts to defer the Learner to a suitable ASP course date, but deferral requests are at the discretion of ASP as are any refunds after any deferral request. All Awarding Body costs arising from a Learner Deferral Request must be met by the Learner. ASP will clearly set out to the Learner what, if any costs are incurred.
  3. ASP reserves the right to pass on any delegate fees incurred with any awarding body.
  4. Learners may be bound by Awarding Body terms and conditions by virtue of enrolling on one of their courses via ASP. In this instance, APS will ensure the Learner is made aware of this situation and will normally issue the Awarding Body Terms and Conditions to the Learner.
  5. ASP regrets we are unable to accept provisional bookings. Bookings are confirmed once submitted and are subject to the cancellation terms above.
  6. All fees quoted are correct at time of publication. However, ASP reserves the right to amend our fees at any time.
  7. These terms and conditions shall be governed and construed in accordance with the laws of England and shall be subject to the exclusive jurisdiction of the courts of England.
  8. Examination Resits

Any Learner who fully attends any ASP course and fails to achieve a pass will be supported by ASP on subsequent re-sit attempts. This support is unlimited (within reason) via email and telephone conferences and one free revision session at our premises will be offered to each Learner resitting an examination. The Learner is responsible for any other costs associated with resitting any examination, including but not limited to fresh enrolment fees.

Classroom Courses.

  1. Minimum and maximum Learner numbers and learner to tutor ratios are determined by the appropriate Awarding Body. ASP will always work within awarding body guidelines.
  2. ASP reserves the right to use multiple tutors on any course, concurrently and / or sequentially.
  3. Course materials are kept under continuous review and are subject to rigorous quality assurance processes. However, ASP cannot be held responsible for any omissions or errors in the course materials.
  4. ASP cannot be held responsible for unforeseen circumstances / Acts of God that affect the running or delivery of a course. We will endeavour to work with our Learners to resolve any such matters to the best of our ability.
  5. ASP reserves the right to amend course venues at any time. Learners will be advised of any venue changes as soon as practicable.
  6. All courses held at our Moth and Lantern venue include refreshments throughout the duration of the course. Courses of one full day or more will also include lunch. Learners should advise ASP in advance of any special dietary requirements.
  7. Free parking is available at our Moth and Lantern venue for the duration of any course.
  8. Course fees do not include overnight accommodation or outside of course-time refreshments.

20. In-house Training. Where courses are delivered on client’s premises, it is the responsibility of the client to provide the following:

  1. A suitable training room, with enough space and facilities for all Learners.
  2. Suitable and sufficient welfare facilities.
  3. Refreshments and lunch as appropriate and at Client discretion.
  4. Projection facilities, and any other equipment as necessary for the delivery of the course.
21. Examinations.
1. Where course fees do not include third party examination fees, this will be made clear when the course is booked.
2. All NEBOSH exams must be booked and paid in full at least 4 weeks before the date of the examination.
3. Where NEBOSH examinations are booked after the NEBOSH cut-off date, additional fees may apply.
